These Terms are an agreement between you and Andrew Lorimer-Derham trading as Think Square, ABN 19 747 680 525 ("Think Square", "we", "us").

1. Definitions

• "Platform": The Think Square website, games, and associated software.
• "Organisation": The entity or individual subscribing to the Platform. This includes, but is not limited to, Schools, Tutoring Agencies, Homeschool Groups, and Families.
• "Administrator": A user responsible for managing an Organisation and its users, such as a teacher, tutor, parent, or an individual managing their own account.
• "Participant": Any user who plays the games. Most Participants are students, but adults may also sign up to play for themselves. An individual can be both the Administrator and a Participant of their own account.

2. Intellectual Property (Ownership)

All content, games, code, graphics, algorithms, and methodologies on this Platform remain the sole property of Think Square (Andrew Lorimer-Derham).

• License to Use: We grant the Organisation a limited, non-exclusive, non-transferable license to access the Platform for educational purposes during the subscription term.
• No Transfer: You may not copy, reproduce, reverse-engineer, sell, or sublicense any part of the Think Square Platform.

3. User Responsibilities

• Pseudonyms & Mapping: If the Organisation chooses to use pseudonyms (fake names) for Participants, the Administrator is solely responsible for maintaining a local record of which pseudonym belongs to which individual. Think Square cannot recover account ownership or assess progress if the Administrator loses this mapping.
• Account Security: You are responsible for maintaining the confidentiality of your login credentials.
• Organisation Join Codes: If the Organisation utilises 'Join Codes' to register Participants, the Administrator is responsible for the secure distribution of these codes. The Organisation must ensure that codes are only provided to authorised individuals and must monitor its user list to remove any unauthorised accounts.

4. Limitation of Liability

The Platform is provided "as is." Think Square is not liable for:

• Internet interruptions or technical failures outside our direct control.
• Data loss resulting from an account being deleted under the Data Retention rules in our Privacy Policy (for example, an account with no active access that nobody has used for 12 months).
• Notifications that are delayed, not delivered, or not displayed (see Section 8).

5. Use by Minors & Consent

If the Organisation allows Participants under the age of 18 to use the Platform, the following applies:

• Organisation Representation: By adding a minor Participant, the Administrator represents and warrants that they have the legal authority to do so. This includes having obtained "verifiable parental consent" or acting in loco parentis as permitted by local education and privacy laws.
• Compliance: The Organisation is responsible for complying with the Children's Online Privacy Protection Act (COPPA), the Australian Privacy Act, and any other relevant student data privacy laws in the jurisdiction where the Organisation is located.
• General Acceptance: All Participants (minors or otherwise) are bound by these Terms. Administrators are responsible for ensuring Participants understand the basic rules of "Account Security" and "Acceptable Use."

6. Acceptable Use & Security

To maintain a safe and productive learning environment, all Users agree to the following:

• Account Security: Users must not share their passwords or account access with others. Administrators must ensure that Join Codes are distributed only to authorised Participants and are not posted in public forums or websites.
• Prohibited Conduct: Users may not attempt to reverse-engineer, scrape, or interfere with the operation of the Platform or its games.
• Organisation Oversight: Administrators are responsible for monitoring their user list and must immediately deactivate any accounts they do not recognise or that are no longer authorised to use the Platform.
• Notification: You agree to notify Think Square immediately if you suspect a Join Code or account has been compromised.
• Reporting Concerns: Anyone can report something unsafe or worrying on the Platform using "Report a concern", linked at the bottom of every page.

7. Third-Party Authentication

If you sign in to Think Square using Google or Microsoft (Single Sign-On, or SSO):

• Account Security: You are responsible for maintaining the security of your Google or Microsoft account. Think Square is not liable for unauthorised access that results from compromise of your third-party credentials.
• Profile Data: We request basic profile information from your login provider solely to retrieve your avatar/profile picture and to obtain your email address for secure account matching. We actively discard and do not store your real first or last name, ensuring your account can be used pseudonymously. We do not access your private files, contacts, or any other data from your Google or Microsoft account.
• We store the unique Social ID provided by Google or Microsoft to link your Think Square account to your social login. This allows you to sign in securely without a separate password.

8. Notifications & Announcements

• Optional: Browser and app notifications are off by default and are only sent to users who turn them on. Users can turn them off at any time in their account settings or their device settings. How notification data is handled is described in our Privacy Policy.
• No Guarantee of Delivery: Notifications depend on the user's browser, device settings and the browser maker's push service. We do not guarantee that any notification will be delivered, delivered on time, or displayed, and the Platform should not be relied on for time-critical alerts.
• Organisation Control: An Organisation Manager can switch notifications off for everyone in their Organisation at any time, under Manage → Change Organisation Details → Notifications.
• In-App Announcements: While logged in, users may see notices about games and features included in their access, such as a new game being added. Notifications and emails about Platform news are only sent to Administrators who choose to receive them.

9. Governing Law

These Terms are governed by the laws of Victoria, Australia. You and Think Square submit to the non-exclusive jurisdiction of the courts of Victoria, and any courts that can hear appeals from them.
