1. Definitions

  • "Platform": The Think Square website, games, and associated software.
  • "Organisation": The entity or individual subscribing to the Platform. This includes, but is not limited to, Schools, Tutoring Agencies, Homeschool Groups, and Families.
  • "Administrator": The primary account holder (Teacher, Tutor, or Parent) responsible for managing Participant accounts.
  • "Participant": The end-user (Student or Child) playing the games.

2. Intellectual Property (Ownership)

All content, games, code, graphics, algorithms, and methodologies on this Platform remain the sole property of Think Square (Andrew Lorrimer-Derham).

  • License to Use: We grant the Organisation a limited, non-exclusive, non-transferable license to access the Platform for educational purposes during the subscription term.
  • No Transfer: You may not copy, reproduce, reverse-engineer, sell, or sublicense any part of the Think Square Platform.

3. User Responsibilities

  • Pseudonyms & Mapping: If the Organisation chooses to use pseudonyms (fake names) for Participants, the Administrator is solely responsible for maintaining a local record of which pseudonym belongs to which individual. Think Square cannot recover account ownership or assess progress if the Administrator loses this mapping.
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials.
  • Organisation Join Codes: If the Organisation utilises 'Join Codes' to register Participants, the Administrator is responsible for the secure distribution of these codes. The Organisation must ensure that codes are only provided to authorised individuals and must monitor its user list to remove any unauthorised accounts.

4. Limitation of Liability

The Platform is provided "as is." Think Square is not liable for:

  • Internet interruptions or technical failures outside our direct control.
  • Data loss resulting from the Administrator failing to renew a subscription within the 12-month retention window.

5. Use by Minors & Consent

If the Organisation allows Participants under the age of 18 to use the Platform, the following applies:

  • Organisation Representation: By adding a minor Participant, the Administrator represents and warrants that they have the legal authority to do so. This includes having obtained "verifiable parental consent" or acting in loco parentis as permitted by local education and privacy laws.
  • Compliance: The Organisation is responsible for complying with the Children's Online Privacy Protection Act (COPPA), the Australian Privacy Act, and any other relevant student data privacy laws in the jurisdiction where the Organisation is located.
  • General Acceptance: All Participants (minors or otherwise) are bound by these Terms. Administrators are responsible for ensuring Participants understand the basic rules of "Account Security" and "Acceptable Use."

6. Acceptable Use & Security

To maintain a safe and productive learning environment, all Users agree to the following:

  • Account Security: Users must not share their passwords or account access with others. Administrators must ensure that Join Codes are distributed only to authorised Participants and are not posted in public forums or websites.
  • Prohibited Conduct: Users may not attempt to reverse-engineer, scrape, or interfere with the operation of the Platform or its games.
  • Organisation Oversight: Administrators are responsible for monitoring their user list and must immediately deactivate any accounts they do not recognise or that are no longer authorised to use the Platform.
  • Notification: You agree to notify Think Square immediately if you suspect a Join Code or account has been compromised.
